RIGHTHOLDER’S RESERVATION CONCERNING TEXT AND DATA MINING
Wirtualna Polska Media Spółka Akcyjna, with its registered office in Warsaw andall its affiliated companies (hereinafter collectively referred to as “Wirtualna Polska”), hereby expressly reserves that, without the prior and explicit consent of Wirtualna Polska, it is prohibited to download, reproduce, store, or otherwise use any content - regardless of its nature or form of expression (including, but not limited to, verbal, verbal-musical, musical, audiovisual, audio, graphic, programming, architectural, visual arts, interactive, social (including UGC), informational (headings, titles, tags, SEO descriptions) content and the data and information contained therein, as well as databases and compilations and the data contained therein) - and regardless of its form (e.g., literary, journalistic, scientific, cartographic, computer programs, visual arts, photographic), that is made available on websites, internet services, and mobile applications belonging to Wirtualna Polska, whether by automated or manual means (including but not limited to web crawlers, software, tools, robots, and activities such as website indexing, database searching and downloading, web scraping, text and data mining, harvesting, or screen scraping) for the purpose of exploration involving, in particular, data analysis aimed at creating, modifying, developing, or training software, machine learning systems, deep learning systems, or internet algorithms, including systems using artificial intelligence technology or its outputs, as well as creating training datasets, language models (LLMs), analytical tools and recommendation systems, image recognition systems, knowledge bases for chatbots, predictive systems, as well as patterns, trends, or correlations. This reservation applies in particular (but not exclusively) to content (in whole or in part) constituting trademarks, logos, visual identity elements, works, artistic performances, phonograms, videograms, programs, broadcasts, transmissions or press publications constituting subject matter of related rights of the publisher and/or industrial property rights, databases and data compilations (including, in particular, the structure of services, content layout, and information architecture), computer programs, source code, and style sheets.
This reservation does not apply to the use of content solely for the purpose of facilitating its indexing by internet search engines and is not intended to exclude or limit consumer rights to use the content within contractual relationships or within the scope of permitted use as provided by applicable law.
This statement constitutes an explicit reservation by the rightholder referred to in Article 4(3) of Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC (OJ EU L 130/92 of 2019), as well as in the provisions implementing the Directive into the national legal systems of the Member States of the European Union, including Article 26(3)(1) and (2) of the Polish Act on Copyright and Related Rights (i.e.: Journal of Laws of 2022, item 2509, as amended).
